1. Usage of Intellectual Property

All content and services available on MyUP.ai are the sole property of the company. Text, graphics, user interfaces, trademarks, logos, audio, and video used in the Service are protected by international intellectual property laws.

You agree not to copy, modify, sell, or distribute any part of the Service or its content without prior written permission.

2. Data Privacy

We collect your IP address to infer location (city and country) to improve the user experience and personalize service offerings.

We share billing information with our payment processor Stripe for invoicing purposes. We do not store full credit card details on our servers.

3. Age Restrictions

You must be at least 18 years old to use MyUP.ai. By using this site, you confirm that you are 18 or older. Accounts found to belong to users under 18 will be deleted, and related data removed in compliance with GDPR.

4. Prohibited AI Uses

Our Service is exclusively designed to generate visual content from text inputs, for presentation and creative non-personal uses only.

It is strictly prohibited to generate or attempt to generate:

  • Face swaps, identity replacement or face modification

  • Deepfakes, or any content intended to imitate, alter, or simulate the identity of a real or fictional person

❗ MyUP.ai does not allow and cannot be used to create face swaps, deepfakes, or representations of real individuals. You are not permitted to create images of a brand or a person without the brand’s or the person’s prior written authorization. Users may only upload their own photos for the purpose of adding graphical elements or text overlays in presentations

Violating these rules may result in immediate suspension or permanent termination of your account.

5. Subscriptions & Pricing

We offer both monthly and yearly subscription plans:

Monthly:

  • Pro – $9.99/month, 200 credits

  • Premium – $24.99/month, 600 credits

  • Expert – $49.99/month, 2,000 credits

Annual:

  • Pro – $100/year, 2,400 credits

  • Premium – $240/year, 7,200 credits

  • Expert – $480/year, unlimited credits

Prices and terms may change. You will be notified at least 30 days in advance via email if changes affect your plan. Continued use implies acceptance of new terms.

6. Cancellation Policy & Refund Policy

To cancel your subscription:

  1. Log in to your account

  2. Visit: https://myup.ai/dashboard/user/payment

  3. Click “Cancel” under your active plan

All subscription payments made to MyUP.ai are non-refundable once billed, except in the following cases:

A technical issue on our end prevents you from using the service for an extended period (more than 48 consecutive hours), and no resolution is possible within a reasonable time.

A billing error has occurred (e.g., you were charged multiple times for the same period or subscribed without authorization).

Refund requests are assessed on a case-by-case basis. If approved, the refund will be processed via the original payment method within 7–10 business days.

7. Account Deletion

To delete your account:

  1. Cancel any active subscription

  2. Visit: https://myup.ai/dashboard/user/settings

  3. Request deletion and confirm your password

Your data will be permanently deleted within 3 business days, in accordance with GDPR.

8. Limitation of Liability

MyUP, its employees, partners, and affiliates are not liable for any indirect or incidental damages, including:

  • Loss of data, profits, or reputation

  • Unauthorized access or changes to your data

  • Use or misuse of AI-generated content

9. Termination of Use

We reserve the right to terminate or suspend access to the Service at any time, without prior notice, for violations of these Terms or misuse of the platform.

10. Prohibited Activities

You agree not to:

  • Use the platform for illegal purposes

  • Share your account access or login credentials

  • Attempt to reverse-engineer or interfere with the service

  • Circumvent any usage monitoring or restrictions

11. Indemnification


You agree to indemnify, defend, and hold harmless MyUP, its affiliates, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or expenses (including legal fees) arising from:

Your use of the Service,

Your violation of these Terms,

Any infringement or alleged infringement of third-party rights, including but not limited to intellectual property, privacy, or publicity rights.

12. Applicable Law

These Terms are governed by the laws of France. Any dispute shall be subject to the exclusive jurisdiction of French courts.

13. Modifications

We may revise these Terms at any time. Updates will be posted on our website and, when significant, communicated via email. Continued use implies agreement to the revised Terms.
